The lawsuit was filed by Deshanae L. Brown, who alleges she was subjected to discrimination based on her race, sex, and disability, citing violations of federal and state laws including Title VII, the Americans with Disabilities Act, and the Family and Medical Leave Act.
The lawsuit specifically argues that the EPA's decision to rescind a 2009 study that determined greenhouse gases are dangerous to public health was illegal. The study, which is the source of what's called the "Endangerment Finding," was one of several justifications - along with things like the Clean Air Act - for the agency's ability to regulate emissions.

Attorneys general from 27 states and the District of Columbia are continuing to pursue the case without the US government, at least for now.

U.S. District Judge William G. Young ruled Thursday that the government must clearly prove any arrest, detention, or change in immigration status is based on a legitimate reason unrelated to retaliation. Young wrote that any attempt to change the immigration status of plaintiffs in the landmark case against the Trump administration will be presumed to be punishment for speaking out - unless the government can show strong evidence that the action was due to a crime, an expired visa, or another valid reason.
The unexpected gravitas occurred in one of the thousands of habeas cases currently swamping trial courts. The Department of Homeland Security recently discovered that 8 USC § 1225(b)(1)(B)(iii)(IV) requires mandatory detention of asylum seekers, including those who were released in the country decades ago and given work permits. Hundreds of judges across the country - but not the Fifth Circuit! - have scoffed at this discovery and ordered DHS to either grant immigrants a bond hearing or release them.
Manhattan Federal Judge Alvin Hellerstein, who reserved decision, appeared unswayed by Trump's position, saying he'd sought two bites at the apple by first trying in state court to get his conviction tossed on account of the Supreme Court's July 2024 decision on presidential immunity and, when that didn't work, refocusing efforts in federal court. The judge said the strategy led Trump to miss the 30-day window to raise the matter federally, without a good cause excuse.
The situation in Minnesota continues to prove an abject nightmare. The Trump administration continues to ignore and flagrantly undermine judges. If the administration put half as much effort into honoring its legal obligations as it places into attacking judges on social media, perhaps they wouldn't be staring down a massive staffing crisis - a crisis they're trying to resolve by asking people on Elon Musk's pornification site to sign up as AUSAs.
